We are delighted to have overturned refusal of outline planning permission for 6 dwellings in the Green Belt in Fifield, Royal Borough of Windsor and Maidenhead for Sagacity Consultants ltd.
The original application was refused primarily on the basis that the Council disagreed the development was ‘infill development’ and therefore concluded it was ‘inappropriate’ development in the Green Belt. The Inspector disagreed with the Council’s narrow interpretation of infill development and concluded that the appeal examples provided as part of our grounds of appeal reinforced the point that ‘whether a proposal amounts to limited infilling is a matter of planning judgement based on the facts in each case.’ In this case, the Inspector was satisfied that there was continuous development either side of the gap, the scale of the gap was modest and the uplift of 5 dwellings was limited in the context of the village. Ultimately the Inspector concluded that the development would not amount to inappropriate development in the Green Belt.
The acceptability of the appearance of the development (Designed by Gebler Tooth Architects) was a matter that was agreed between the parties.
Submissions on highways, drainage and sustainability overcame further reasons for refusal.
